This exception won’t apply and you will be required to wait five years if: • you separate or divorce legally prior to your interview • you choose to stop living with your spouse, or • your spouse dies. Also, your spouse must be a citizen during all of your three years of permanent residency. If, for ­example, your spouse had a green card when you got married and became a naturalized citizen one year later, you’ll have to wait three years from the date he or she became a citizen—that is, for a total of four years.
